Laurel Education Terms of Service

1. Agreement to Terms

By creating an account or using Laurel Education (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. If you are using the Service on behalf of a school or school board, you represent that you have the authority to bind that organization to these Terms in respect of your use.

2. Description of the Service

Laurel Education is a web application, installable on Windows, Mac, iOS, and Android, that helps teachers record classroom observations about students, organize them by subject and student, and generate AI-assisted draft report card commentary based on those observations.

3. Eligibility and Accounts

• You must be at least the age of majority in your province of residence, and an educator (or otherwise authorized by a school), to create an account.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must provide accurate information and keep it up to date.
• Notify us promptly at hello@shadowtailapps.com if you suspect unauthorized use of your account.

4. Your Responsibility for Student Data

You are solely responsible for:

• Ensuring you have the appropriate legal authority, consistent with your school’s or board’s policies and applicable law, to enter student information into the Service.
• The accuracy of the student information and observations you enter.
• Reviewing and editing AI-generated commentary before relying on it for any official purpose (see Section 6).
• Complying with your school board’s data handling and privacy policies, which may impose requirements beyond this Service.

Laurel Education acts as a data processor / service provider for the Student Data you enter. You — or your school — remain the data controller responsible for that information under applicable privacy and education law.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Enter information about students you are not authorized to record information about.
• Attempt to access another Account Holder’s data or circumvent the Service’s security controls.
• Reverse-engineer, scrape, or overload the Service — automated or excessive requests may be rate-limited or blocked.
• Use the Service to generate or store content that is defamatory, discriminatory, or otherwise unlawful.

6. AI-Generated Content

• The Service uses a third-party AI model (Anthropic’s Claude) to generate draft report card commentary based on the observations you provide.
• AI-generated content is a starting draft, not a finished or verified evaluation. It may be inaccurate, incomplete, or fail to reflect your professional judgment.
• You are solely responsible for reviewing, editing, and approving any AI-generated content before using it in a report card, communicating it to a parent or guardian, or otherwise relying on it in a professional capacity.
• We do not guarantee the accuracy, appropriateness, or curriculum alignment of AI-generated content.

7. Intellectual Property

The Service itself — its software, design, and branding — is owned by Laurel Education and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or underlying source code.

As between you and Laurel Education, you (or your school or board) retain ownership of the Student Data you enter. You grant us a limited license to store, process, and display that data solely to provide the Service to you, including transmitting relevant observation text to our AI provider as described in Section 6 and in our Privacy Policy.

8. Fees

Laurel Education is priced at $9.99/month or $90/year for an individual teacher. Schools and boards receive volume pricing — contact us at hello@shadowtailapps.com for a quote. We’ll give advance notice before any pricing change takes effect for existing Account Holders.

9. Termination

9.1 By You

You may delete your account at any time from within the Service, at Settings → Password & Security → Delete Account. This immediately and permanently deletes your account and all associated Student Data.

9.2 By Us

We may suspend or terminate your access if you violate these Terms, or if required by law. Where reasonably possible, we will provide notice first.

9.3 Effect of Termination

Upon termination, your right to use the Service ends. Sections that by their nature should survive termination — including Sections 7, 10, 11, and 12 — will survive.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, EXCEPT AS PROHIBITED BY APPLICABLE LAW. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAUREL EDUCATION WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from these Terms or the Service will not exceed the greater of CAD $100 or the amount you paid us in the 12 months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold Laurel Education harmless from claims arising from your breach of these Terms, your violation of applicable law, or your lack of authority to enter Student Data into the Service.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, notify Account Holders by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
